Board Certified in Criminal Law · Former Felony Chief Prosecutor · Member of the Elite Vehicular Crimes Team
Board Certified in Criminal LawTexas Board of Legal Specialization — a distinction held by roughly 7,200 of the 110,000+ lawyers in Texas.
Being charged with a crime is one of the most physically and mentally draining things that can happen to you. You don't have to live in fear, and you don't have to go into the fight alone.
Luis and I are both former prosecutors, and we understand how the system works from the inside. We know how to spot the weaknesses in the government's case so that you have the best possible chance at success. Anybody can have a bad day — we help regular folks who have found themselves stuck in the criminal justice system and need to find a way out.
Don't live with the stress of a criminal case. Let us help.
— Brian Foley
From the Prosecutor's Table to Your Defense
Brian Foley began his legal career as a prosecutor and rose to become a Felony Chief Prosecutor — one of the most senior trial positions in a district attorney's office. In that role he was responsible for a third of all the cases filed in Houston, from Driving While Intoxicated and assault to the most serious felonies, including Capital Murder. He supervised younger prosecutors, made charging decisions, negotiated dispositions, and tried cases in front of juries.
That inside experience is the heart of how he defends clients today. Brian knows how the State evaluates a file, where prosecutors feel pressure, which evidence actually holds up at trial, and which cases fall apart under scrutiny. When the government is building a case against you, there is real value in having a lawyer who used to build those cases himself.
What Board Certification Really Means
Brian is Board Certified in Criminal Law by the Texas Board of Legal Specialization. It is not a marketing label — it is a formal certification that requires substantial trial experience, peer review from judges and attorneys, and passing a rigorous specialty examination. Fewer than 7,200 of the more than 110,000 lawyers licensed in Texas hold it. When you hire a Board Certified criminal lawyer, you are hiring someone the State's own certifying body recognizes as a specialist in this exact area of law.
Trained in the Science of DWI and Vehicular Crimes
Brian was selected to the elite Vehicular Crimes Team, the unit dispatched to the scene of intoxicated-driving offenses involving serious injury or death — the most serious driving cases a prosecutor's office handles. He received the highest level of training available in these cases, from crash-scene investigation and accident reconstruction to blood and breath testing and the prosecution of Intoxication Assault and Intoxication Manslaughter. In an intoxication case the test result is often the centerpiece of the State's evidence — and Brian knows exactly where those results, and the procedures behind them, can break down.
A Legal Analyst the Media Trusts
Because of his depth of experience, Brian is regularly called on to provide legal analysis on high-profile criminal cases. He has appeared as a legal analyst for ABC13, FOX 26, and Nancy Grace's Crime Stories, breaking down charges, evidence, and courtroom strategy for national audiences. That same clarity is what clients get when Brian explains their own case and their options.
